Terms & Conditions

The terms that apply when you purchase a module through MODules.

These terms and conditions apply to every offer, order and purchase made through MyPrestaShopModules.com. They describe your rights and obligations, and ours, when you buy and download a PrestaShop module from us. Please read them carefully before placing an order.

Who we are and scope of these terms

[Company name], located at [address], [postal code] [city], the Netherlands, registered with the Dutch Chamber of Commerce (Kamer van Koophandel) under number [Chamber of Commerce number] ("we", "us", "MODules"), offers the modules on this website. These terms apply to every offer we make and to every agreement concluded between us and you as a customer ("you"). By placing an order you accept these terms in full. You can reach us at support@myprestashopmodules.com.

Definitions

In these terms, the following terms have the meaning given below:

  • Website: myprestashopmodules.com and all pages it consists of.
  • Module: a digital software extension for PrestaShop that we offer for sale on the Website.
  • License: the non-exclusive, non-transferable right to use a Module as described in article 8.
  • Order: your request to purchase one or more Modules, placed via the Website.
  • Agreement: the purchase agreement between you and us that comes into existence when we accept your Order.
  • Download link: the unique, temporary and personal link through which a purchased Module can be downloaded.
  • Consumer: a customer who is a natural person acting for purposes outside their trade, business, craft or profession.

The offer and prices

All offers on the Website are without obligation and may be adjusted or withdrawn at any time. Prices are stated in euros (EUR) and include Dutch VAT unless stated otherwise. Obvious mistakes or errors in the offer, such as an unrealistic price, do not bind us. We reserve the right to correct such errors, even after you have placed an Order.

Placing an order and forming the agreement

The Agreement comes into existence at the moment we confirm your Order by e-mail, or, if earlier, at the moment your payment via Mollie is confirmed as successful. We may refuse an Order or attach conditions to it, for example in case of a reasonable suspicion of fraud or of abuse of a previous License.

Payment

Payments are processed through our payment provider Mollie. The following applies to payment:

  • Payment is due immediately when placing the Order, before the Module is made available for download.
  • You can pay using the methods offered by Mollie at checkout, such as iDEAL, credit card or Bancontact.
  • All payments are SSL-secured and processed in accordance with PSD2 requirements.
  • The Agreement is only concluded once your payment has been confirmed as successful.
  • If a payment fails, is cancelled or is not completed, no Agreement comes into existence and no amount is charged.

Delivery and access to downloads

Modules are digital products and are not shipped physically. After your payment has been confirmed, you receive an e-mail with a personal Download link within a few minutes. This link can be used once and expires after the period stated in the e-mail. Customers with an account using the same e-mail address can download the Module again at any time under My account. If you experience problems downloading your Module, please contact us at support@myprestashopmodules.com so we can assist you or issue a new Download link.

Right of withdrawal for digital content

As a Consumer, you normally have the right to withdraw from a distance purchase within 14 days without giving reasons. For digital content that is not supplied on a tangible medium, such as our Modules, this right of withdrawal no longer applies once we have started delivering the Module, provided that:

  • you have expressly requested that delivery starts during the withdrawal period, for example by downloading the Module directly after payment;
  • you have expressly agreed to this when placing your Order, by accepting these terms;
  • you have expressly acknowledged that you thereby lose your right of withdrawal;
  • the Module has actually been made available to you through the Download link;
  • no right of withdrawal applies once downloading has started, in accordance with Article 6:230p, opening words and under (f), of the Dutch Civil Code and Article 16(m) of Directive 2011/83/EU.

Should you nevertheless wish to request a refund before you have downloaded the Module, please contact us at support@myprestashopmodules.com and we will assess your request in good faith.

License and usage rights

When you purchase a Module, you obtain a License to use it under the following conditions:

  • The License is non-exclusive, non-transferable and limited to the number of domains or shops stated for the purchased tier (Starter, Pro or Agency).
  • You may install and use the Module only on your own PrestaShop shop(s), on the domain(s) for which the License was purchased.
  • The License does not transfer ownership of the Module; all rights remain with us or the original author of the Module.
  • You may not sublicense, sell, rent out, lend or otherwise make the Module or your License available to third parties.
  • We may periodically verify the validity of your License, for example through a domain check, as described in our privacy policy.

Updates and support

Depending on the tier you purchased, you are entitled to updates and support for the period stated on the Module's product page at the time of purchase, for example one year, two years or lifetime updates. Support is provided on a best-effort basis by e-mail and, for higher tiers, by phone, and aims to help you install and use the Module correctly. Support does not include custom development or modifications to other parts of your shop, unless separately agreed.

Prohibited use

When using a Module and your License, you may not:

  • circumvent, remove or disable license checks, security measures or download restrictions;
  • reverse engineer, decompile or disassemble the Module, except to the extent expressly permitted by law;
  • copy, distribute, resell, sublicense or otherwise share the Module or its source code with third parties;
  • use the Module on more domains or shops than covered by your License;
  • use the Module for any unlawful purpose or in a way that infringes the rights of us or third parties;
  • remove or alter any copyright, trademark or other proprietary notices contained in the Module.

Intellectual property

All intellectual property rights relating to the Website and the Modules, including copyrights, trademarks and database rights, belong to us or our licensors. Nothing in these terms or the Agreement transfers any intellectual property right to you, other than the limited License described in article 8. PrestaShop® is a registered trademark of PrestaShop S.A. We are an independent provider and are not affiliated with, endorsed by or officially connected to PrestaShop S.A.

Liability

We are only liable for damage that is the direct and demonstrable result of an attributable shortcoming on our part. Our total liability under the Agreement is limited to the amount you paid for the relevant Module. We are not liable for indirect damage, including but not limited to lost profit, lost savings, business interruption or damage caused by improper installation or use of the Module. Nothing in this article limits our liability where this is not permitted under mandatory Dutch or EU consumer law.

Force majeure

We are not obliged to fulfil any obligation towards you if we are prevented from doing so as a result of force majeure, including but not limited to internet or hosting outages, failures of our payment provider, cyberattacks, power failures, illness of key personnel, and other circumstances beyond our reasonable control. We will inform you as soon as possible if force majeure affects the delivery of your Order.

Complaints and disputes

If you are not satisfied with a Module or with our service, please contact us first at support@myprestashopmodules.com so we can find a solution together; we aim to respond within one business day. If we do not reach a solution, you may, as a Consumer residing in the EU, also submit your complaint via the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Applicable law and jurisdiction

These terms and every Agreement are governed exclusively by the laws of the Netherlands. Any dispute that cannot be resolved amicably will be submitted to the competent court in the Netherlands, without prejudice to your right as a Consumer under mandatory law to bring proceedings before the court of your own place of residence instead.

Changes to these terms and contact

We may amend these terms from time to time, for example in response to changes in our services or in legislation. The version that applied at the time you placed your Order remains applicable to that Order; the most recent version is always available on this page. Do you have questions about these terms? Please contact us at support@myprestashopmodules.com.
